[IndianaTrails] Destruction of rail bed

Hello all!  This is my first post to the forum.  I am the Vice President of the B&O Trail Association.  We have recently learned that an adjacent owner has leveled a portion of the rail bed that he does not own.  It is owned by CSX per the class-action suit.  Does anyone have any ideas as to how we can address this issue prior to negotiating for purchase from CSX?  I'm pretty sure CSX has no interest in pursuing the matter on its own behalf.  Is there some language that can be used in a purchase agreement, which would transfer CSXs remedies to the purchaser?
